In particular how best to manage insured disputes in ways which meet the commercial needs of policyholder and insurer alike.

Examples of work

  • Acting for an Icelandic bank which leant over £7million to facilitate the purchase of shares in a UK retailer which became involved in a dispute over a share pledge and alleged preference.  
  • Acting for a major household name in the hospitality and leisure sector in managing a Law of Property Act Receivership of over 250 pubs and hotels. The work involved advising on the implications of guarantees, the enforceability of the client's security and formulating a strategy to mitigate the client's potential losses. It then involved extensive project managing of a number of our lawyers across several departments in order to advise on a variety of issues over a four year period. The strategy was effective and assisted the client with saving over £12m.
  • Advising on a multi-jurisdictional dispute between international investment banks involving foreign exchange currency transactions totalling £97m.
  • Acting on behalf of a major high street bank in relation to the recovery of a debt in excess of £32m. In addition, we advised on a subsequent counterclaim for £92m regarding allegations of duress, sales at an undervalue and overriding beneficial interests.

Advising in relation to fraud including:

  • Advising in regulatory investigations and enforcement brought under the Proceeds of Crime Act 2002 involving suspected fraud, corruption, misconduct and regulatory non-compliance across the EU

  • Advising directors and managers during interviews under caution, documentation and information requests and the use of regulators' statutory powers
  • Obtaining on a freezing injunction against a fraudulent mortgagee applicant and asset recovery.

Advising on insurance issues relating to:

  • The collapse of the Icelandic banking system and claims against directors and officers (with a value of €100+ million)
  • Market-wide/systemic financial product mis-selling claims and group actions in Eastern Europe
  • Claims against a UK investment fund manager emanating from African investors
  • Sub-prime mortgage fraud and breach of fiduciary duty claims against directors at a well-known mortgage intermediary
  • Claims arising out of residential property mortgages linked to the consumer price index
  • Third party losses caused by stolen cheques.
