In particular, we advise a number of clients on equal pay issues and have been involved in litigation relating to the determination of test issues of national importance. We regularly advise and represent clients in relation to complex equal pay claims, both in the employment tribunal and in the appellate courts. We negotiate and structure the settlement of equal pay claims. We conduct assessments of equal pay risk and advise on job evaluation schemes. We have experience of advising clients on issues raised by the Equality and Human Rights Commission.

Examples of work

  • Advising a transport company on a complaint received from the Equality and Human Rights Commission in relation to its duty to make reasonable adjustments for passengers.
  • Working closely with a national infrastructure client on driving forward its diversity and inclusion programme by working with key HR contacts in the delivery of an inclusive leadership programme.
  • Acting for a NHS trust in relation to its defence of a large number of equal pay claims. The advancement of technical issues resulted in the withdrawal of the vast majority of the claims, with the remainder being struck out by the employment tribunal.
  • Advising a  national logistics business in relation to equal pay litigation it inherited through TUPE transfers, including representation at the employment tribunal and making successful applications to have the claims struck out.
  • Advising the NHS Litigation Authority on the successful defence of a challenge to the national NHS pay and grading system, Agenda for Change. Our work ensured that Agenda for Change operated to provide a defence to future equal pay claims in the NHS
  • Advising a transport infrastructure business on its response to a complaint from the Equality and Human Rights Commission relating to access to its facilities
  • Advising a financial institution on its response to a complaint from the Equality and Human Rights Commission in relation to access to its services for hearing impaired customers
  • Defending a retailer, which also provides financial services products, from seven service provider discrimination complaints over a number of years.  The majority, but not all, of these claims have related to allegations of failure to make adjustments for disabled customers and a number of them involve the consideration of complex issues relating to how financial services products are provided/delivered.  In the majority of these cases we have successfully persuaded potential Claimants not to issue proceedings and therefore saved the client significant legal costs.
  • Defending a transport infrastructure business against potential judicial review proceedings in which the potential Claimant's alleged that it had failed to comply with the public sector equality duty when making a decision about refurbishing properties that were leased to commercial tenants.
  • Providing bespoke training to clients in the retail, financial institutions and insurance sectors on how to limit the risks of receiving discrimination claims from customers. Training sessions delivered have been both tailored to individual clients' sectors and specific issues that were coming up regularly for those clients from a customer service perspective.
