Examples of work

  • The Southern, Central England, Lincolnshire, Midcounties and Scottish Midland Co-operative Limited - We were instructed by the five largest regional independent co-operative societies to act for them on their proposed Buying Services Agreement (BSA) with Co-operative Group Limited in Manchester. A key component of this was a licence to each of the "co-operative" and related brands by group to each of the 16 regional independent co-operative societies, including for use on the fascias of 2,800 stores around the UK. The transaction was critical for the parties, because it was core to their operations but also because the 16 independent regional co-ops (of which our clients were the largest) had made it clear that, unless the BSA was agreed in time, they would not vote in favour of the resolutions to be put at the special meeting of the members of the Co-operative Group radically restructuring its governance, in line with the recommendations of the Myners Report. 
  • Jemella Group Limited t/a ghd - We successfully represented this manufacturer of the iconic ghd hair straightener in defence of a patent entitlement dispute brought by an electronics design company. Uniquely, at the client’s request Patrick Cantrill, who has acted for ghd for many years, not only prepared the defence but also at a two day hearing before the United Kingdom Intellectual Property Office, (“UKIPO”) which involved the cross examination of the applicant’s three witnesses, acted as the solicitor advocate against the applicant’s specialist IP counsel.  
  • Belmond - We successfully acted for this leading chain of luxury hotels in the successful cancellation of a UK registered trade mark which was in direct conflict with one of the chain’s key assets.
  • English Heritage - We advised on the de-merger of English Heritage to separate running of historic buildings from EH’s regulatory and advisory role in respect of listed and historic buildings. This was of major strategic importance to the client. We advised on the intellectual property provisions of the documentation, including trade mark and other intellectual property licences. Other teams in the firm dealt with all other aspects of the matter. We dealt with the in-house lawyer at EH responsible for IP matters.
  • PPG Architectural Coatings - In May 2014, in place of Walker Morris LLP, the UK subsidiary of PPG Inc, the largest USA based paint manufacturer, appointed Bond Dickinson LLP for the defence and counterclaim of the high profile comparative advertising trade mark infringement proceedings begun in the High Court in 2012 by Farrow & Ball who have instructed Kempner & Partners.
